I know because my relatives use Hotmail in Outlook via POP on Next G wireless – takes forever to send mail.

The reason for this is that I find Gmail's SMTP server to be hideously slow – often taking minutes to send a 500KB file (and with an upload speed of 2mbit – that's just not right).

And what happens if you don't agree with the new terms?

Of course if you follow the old rule "never put anything in an email that you wouldn't put on a postcard" there should be no problems but I am totally against passing my email to foreign government control!

At least here in Australia they need to convince a court that there is a legal reason to get Bigpond to allow access to them. With this change that little email server is going to be discontinued for storing your emails for you to access and the mail server that you will get your emails from, will be hosted outside Australia somewhere. Sorry Telstra, there is no way I am going to agree to a contract variance that exposes my personal data to a government outside Australia.

People will undoubtedly argue I do already if my mail transits foreign countries, but it is a reasonable expectation to have my mail account provided to me by an Australian company to be hosted here in Australia.

And we all know that 2/3 of their customers don't know enough about how to change the email settings on their systems.

The question thats not getting a clear answer is whether the fact that Bigpond want to change the terms of your contract with them (apparently they require u to agree to the new terms ) to enable the transfer of your email account to hotmail is sufficient grounds to break any existing Bigpond contract with a "get out of jail free" card ?

I'd say you are correct in your suspicions regarding privacy though.
